Terms and Conditions of Trading – MY ROOM

These Terms and Conditions of Trading apply to all consumer contracts between My Room and our subcontractors (“us/we/our”) and the customer (“you/your”) in relation to sales of goods and services for all orders placed in or via our shop or through the web page.  Please initial each page and sign on page 3

If the Terms and Conditions of Trading have been forward electronically to the number or email supplied, after an order has been placed, the Terms and Conditions of Trading will be acknowledged as signed and agreed, upon receiving and/or reading.                                                                                                                                                                              

1.  Product specifications

1.1 We had a policy of continuous product development and reserve the right to amend the specification of products without prior notice in relation to future sales.

1.2 All furniture is handmade and thus unique and cannot be precisely reproduced.                       

1.3 Some furniture has quality natural wood exposed, for example legs.  Some woods will discolour with age and exposure to sunlight.

1.4 We will endeavour to match the colour and texture of the furniture as accurately as possible, but variation in both the colour and texture may occur.  My Room cannot guarantee the colour, grain, or tint of any wood. 

1.5 The lead time on all orders are four to six weeks from the date ordered, keep in mind that the date ordered will not be the same as the invoice date, but rather the date the payment reflects on our bank statements.

1.6 The lead time may vary as a result of Public Holidays, (especially during December and January), load shedding, cold weather, third party manufacturing and factory delay.

1.7 There will be an extra charge of 4% for any colour ordered other than our standard white or grey. 

1.8 Customers have a choice of Chalk Paint or PVC.  Please note that the texture of Chalk Paint and PVC paint differs.

1.9 The same colour of a small colour sample may vary on a large surface.  The colour shown on digital media made very from the colour in natural light.

1.10 Standard packaging is Bubble wrap.  Aerothene and palletwrap  will be available at R100 per item.  An additional charge of R300 per item will apply for goods that are secured with wooden planks (boxed), for additional protection during transport.  Please allow time required for boxing before finalizing transport arrangements.

1.11 Two layers of waterproofing will be painted on the tops of bathroom vanities.  There will be no shelves unless specified and at an additional charge.

1.12 A selection of handles is available.  Choices exceeding R 45 per handle will be for the clients own account.

1.13 The colour of the inside of the drawers may vary from the outside colour if painted.

1.14 The selling price does not include repainting of furniture. If requested, there will be an additional charge.

2.  Measurements

2.1 It is your responsibility to ensure that the furniture ordered will pass freely through and into your room of choice.

2.2 Delivery contractors do not allow for the removal of doors, windows or other fixtures. Please arrange for any such work beforehand.

2.3 The measurement of all furniture and furnishings of MY ROOM will be as accurate as possible but is nevertheless approximate.

2.4 When ordering customised items:  The measurements specified are those of flat tops and feet included.  For cupboards tops are excluded.  Take skirtings and cornice into consideration when ordering custom made furniture.

2.5 It is the client’s responsibility to inform MY ROOM of any restrictions to and into their premises, measurements that needs to be altered or any other specifications to be taken into consideration regarding the design.

2.6 If no specific measurements are supplied by the customer, MY ROOM will use their own discretion.  If a design(s) / or parts thereof are not practical, MY ROOM may alter it without prior notice to the customer in order to improve the design and quality.                                                                                                                                                                       

3. Prices and quotations

3.1 Quotations are valid for 7 days from the date issued after which it will be subject to withdrawal or alteration by MY ROOM                                                                                                                          INITIALS

3.2 All distributed MY ROOM publications are maintained as sources of general information and not binding in any way.

4. Payments and Acceptance of Contract

 4.1 All orders have 50% of the total amount payable taken at the point of order. The deposit is not refundable with cancellation of a customer order for any reason whatsoever.

4.2 It is your responsibility to ensure that all the details on the invoice are correct and complete and you are aware that MY ROOM’s sales-person has no authority to vary these terms of conditions of sales and MY ROOM assumes no liability and shall not be bound by any statements, warranties or representations made by such sales-persons save as expressly stated in writing and signed by the owner of MY ROOM.  

4.3 We are entitled to refuse any order placed by you

4.4 The balance is payable before delivery or collection of an order.

4.6 All payments are to be made in terms of the conditions stipulated in the contract

5. Collection/Delivery

5.1 We will contact you to arrange a collection date when the furniture is done.  We are unable to store your order and it must be collected within three days of notice.  If you are unable to do so due to your default, charges will be incurred, payable before collection.  We will assist with delivery arrangements, however we do not offer a  delivery service. We will advise you of this charge at the relevant time. After the expiry of 1 month, If no arrangements have been made for collection, your order shall be cancelled, you will forfeit all monies paid and the item will be sold to recover all costs.

5.2 All furniture must be inspected by you prior to collection/delivery and before it exits the premises of MY ROOM.

5.3 Most deliveries are a two man services.  Please take into consideration awkward access, stairs, over walls, removal of doors, windows.  It is your responsibility to ensure that furniture ordered will pass freely through into your room of choice.  Our standard delivery contacts do not includes services  for removal of doors, windows or other fixtures. Please arrange additional help when offloading large pieces.

5.4 Any changes made by you to the content of your order will impact on your collection date.

5.5 Lead time and Time of delivery is not of the essence in these terms and conditions of trading.  We will not be liable for any direct or indirect loss of profits or other financial loss or damages suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of MY ROOM or delay due to any reasonable rescheduling of delivery.

5.6 MY ROOM have courier contact details on request. All arrangements with transport must be done by the client. Additional transport insurance by the client is advised.

6. Guarantees/Returns

6.1 The guarantee do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting and corrosion), damages due to an unreasonable exposure  to water, heat or weather, damages due to fire, smoke, explosion, lightning, sunlight, infection by animals or boring insects, theft or accidental damages or loss caused by a third party.

6.2 MY ROOM has a no-return, no-refund policy regarding items that were discontinued, on sale, sourced, created or altered specifically for you.

6.3 If goods are to be returned, needs to be replaced, needs to be altered, or being attended to for whatever reason, the cost of transport will be for the clients account.

6.4 If the client changes the standard colour scheme, it is their responsibility to double check the colour provided as colours on smaller sample, or via digital media may appear different.  Please ensure that  the colour is correct before painting and delivery. If no color code or sample if provided, MY ROOM will use a colour matching the requested colour on own discresion.

6.5 We will gladly repaint any item if the client decides to change the colour as stated on the invoice.  The additional cost for the paint, transport and labour will be for the clients account.

6.6 As all custom made orders are designed and manufactured to the client’s specifications, our no-return policy will apply.  If the client cancels an order at any time, the deposit will be forfeit in order to recover all costs.

6.7 All compalints must be directed to MY ROOM and client agrees to refrain from any social/published comments that can harm the reputation of MY ROOM                                                                                                                          

6.8 You consent to the jurisdiction of the Magistrate’s Court having jurisdiction over you, irrespective of the amount in dispute.  All costs and disbursements, including Attorney and own client costs incurred by MY ROOM in enforcing its rights in terms hereof, including but not limited to the collection, commission, and tracing fees shall be borne by you.
